1. Agreement to Terms
By purchasing, downloading, accessing, or using ShipCommerce ("the Product"), you ("the Buyer", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not purchase or use the Product.
These Terms constitute a legally binding agreement between you and ShipCommerce ("we", "us", or "our") and govern your use of our website at shipcommerce.io, the source code, documentation, and all related materials provided upon purchase.
2. License
Upon purchase, you are granted a non-exclusive, non-transferable, perpetual license to:
- Use the Product for unlimited personal and commercial projects
- Modify the source code to suit your needs
- Use the Product for client projects
You may not:
- Redistribute, resell, sublicense, or share the source code with others
- Create derivative products for sale that are substantially similar to ShipCommerce
- Share your GitHub repository access with non-purchasers
- Claim the Product as your own original work
- Use the Product to create a competing product or template
Violation of these license terms will result in immediate termination of your license and may result in legal action.
3. Purchases and Payments
All purchases are processed securely through Stripe. Prices are listed in Euros (EUR) and include applicable VAT for EU customers.
Starter Plan (€195): Includes full source code, all current features, and documentation. Does not include future updates or email support.
Professional Plan (€349): Includes everything in Starter, plus 6 months of free updates and email support.
Lifetime Plan (€495): Includes everything in Starter, plus lifetime updates, priority email support, and priority feature requests.
4. Refund Policy
Due to the digital nature of this product, all sales are final and non-refundable. Once you receive access to the source code (via GitHub invitation or download), the purchase cannot be refunded under any circumstances.
By completing your purchase, you acknowledge that you are buying a digital product and waive any right to a refund, chargeback, or payment dispute once access to the source code has been delivered.

5. Delivery
After successful payment, you will receive access to the Product via:
- GitHub Repository Invitation: Sent to the email address used during checkout. Check your spam folder if you don't see it within a few minutes.
- Direct Download: If we cannot find a GitHub account associated with your email, you will receive a download link instead.
6. Support
Starter Plan: Includes access to documentation only. Does not include email support.
Professional Plan: Includes access to documentation and email support for critical technical issues with the Product itself, but does not include custom development, deployment assistance, or general programming help.
Lifetime Plan: Includes priority email support with faster response times.
Support is provided on a best-effort basis. We do not guarantee response times or resolution of all issues. Bug fixes and patches are provided at our sole discretion and are not guaranteed within any specific timeframe. Support does not include: custom feature development, third-party integration debugging, server/hosting configuration, or any work beyond the scope of the Product itself.
7. Updates
Starter Plan: You receive the version of the Product available at the time of purchase. Future updates are not included.
Professional Plan: You receive 6 months of free updates from the date of purchase. After this period, access to new updates is no longer included. Updates are delivered through the GitHub repository.
Lifetime Plan: You receive all future updates to the Product for as long as the Product is actively maintained. Updates are delivered through the GitHub repository.
Lifetime Plan customers receive all future feature updates and improvements for as long as the Product is actively maintained. We reserve the right to discontinue the Product or stop providing updates at any time, without prior notice or liability. "Lifetime" refers to the lifetime of the Product, not the lifetime of the Buyer.
8. Disclaimer of Warranties
THE PRODUCT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.
We do not warrant that:
- The Product will be error-free, bug-free, or uninterrupted
- The Product will meet your specific requirements or expectations
- The Product will be compatible with all environments, servers, or third-party services
- Any defects or errors will be corrected
- The Product will generate any specific revenue, profit, or business results
- The Product is secure against all possible vulnerabilities or attacks
Software inherently contains bugs and may require modifications to work in your specific environment. You are solely responsible for testing the Product thoroughly in your own environment, implementing appropriate security measures, and ensuring it meets your requirements before deploying to production.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SHIPCOMMERCE, ITS OWNER, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business opportunities
- Loss of data or data breaches
- Business interruption or downtime
- Cost of substitute goods or services
- Any damages arising from security vulnerabilities, bugs, or software defects
- Any damages arising from third-party integrations (Stripe, Supabase, Vercel, etc.)
- Any damages resulting from unauthorized access to your deployment
IN ANY CASE, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT.
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless ShipCommerce and its owner from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to: (a) your use or misuse of the Product; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any claim by a third party arising from your deployment, modification, or use of the Product; (e) any data breach or security incident related to your deployment of the Product.
11. Your Responsibilities
By using the Product, you acknowledge and accept that you are solely responsible for:
- Testing the Product in your environment before deploying to production
- Implementing appropriate security measures for your deployment
- Keeping your dependencies, API keys, and credentials secure
- Complying with all applicable laws, regulations, and industry standards (including GDPR, PCI-DSS, etc.)
- Maintaining backups of your data and code modifications
- Any modifications you make to the source code and their consequences
- Ensuring your use of third-party services (Stripe, Supabase, etc.) complies with their respective terms
12. Dispute Resolution
In the event of any dispute arising from or relating to these Terms or the Product, the parties agree to first attempt to resolve the dispute through good-faith negotiation via email for a period of 30 days.
If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration body in the jurisdiction specified in Section 13. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria, without regard to its conflict of law provisions. Any legal proceedings shall be conducted exclusively in the courts of Sofia, Bulgaria.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Product after changes constitutes acceptance of the modified terms. It is your responsibility to review these Terms periodically.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ShipCommerce regarding the Product and supersede all prior agreements, representations, and understandings.
